The High Court has blocked Kampala City businessman Medard Kiconco from evicting residents of Lusanja.
On Thursday, court presided over by Justice Henrietta Wolayo issued a stay of execution order after considering the interests of hundreds of people due to be evicted.
Last month businessman Kiconco obtained an eviction order from the Deputy Registrar of the High Court Deo Ninzeyimana.
However, the residents through their lawyer Nalukoola Luyimbazi also filed an application seeking to stay the eviction order until the Court of Appeal addresses their grievances arising from a 2019 Judgement delivered by the then High Court Land Division Judge Tadeo Asiimwe.
According to the order issued, residents must occupy the contentious piece of land until the Appellant Court disposes the appeal.
In the appeal, the residents challenge Justice Tadeo Asiimwe’s Judgement that ordered them to vacate after declaring them as trespassers on the land where they claim that they rightfully acquired Bibanja interests.
The Minister for Lands Beti Kamya has since started negotiations with Kiconco to see if they can purchase the land in question on behalf of the residents.
